Terms of Service
Effective 19 September 2026
These Terms of Service (the “Terms”) are an agreement between you and Purple Spiral LLC, trading as My3D.Shop (“we”, “us”) governing your use of the My3D.Shop platform, websites and related services (the “Service”). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of a business, you confirm you have authority to bind that business.
1. Who we are
Purple Spiral LLC is a limited liability company based in Georgetown, Texas, United States, operating the My3D.Shop platform. References to My3D.Shop in these Terms mean Purple Spiral LLC.
2. The Service
My3D.Shop provides hosted e-commerce storefronts for 3D printing businesses (“Stores”), including product catalogues, checkout, order management, shipping tools and customer emails. You operate your Store; you decide what to sell, at what price, and you fulfil the orders. We provide the software.
3. Accounts
- You must be at least 18 and provide accurate account information, keeping it current.
- You are responsible for all activity under your account and for keeping your credentials confidential. Tell us promptly at the contact below if you suspect unauthorised access.
- You may invite staff to your Store within your plan's seat limit. You are responsible for their actions.
4. Subscriptions, billing and the money-back guarantee
- Pay first, no trial. Plans are billed in advance, monthly or annually, at the prices shown on our pricing page when you subscribe. Your Store goes live on successful payment.
- 30-day money-back guarantee. Within 30 days of your first payment you may cancel from your dashboard for a full refund of that payment. The refund is issued to the original payment method, your subscription ends and your Store goes offline. The guarantee applies once per business and email address; it does not apply to reactivations after a refund has been claimed.
- Renewals. After the guarantee period, subscriptions renew automatically at the end of each billing period until cancelled. Cancelling stops future renewals; we do not refund the remainder of a period already paid, except where required by law.
- Plan changes. Upgrades take effect immediately and are pro-rated. Downgrades apply at the next renewal. If a downgrade puts your Store over a plan limit (for example products or staff seats), we may ask you to reduce usage before it applies.
- Platform fee. Each plan carries a platform fee, expressed as a percentage of each sale made through your Store, collected automatically through Stripe when the customer pays. It is in addition to Stripe's processing fees, which Stripe charges you directly under your agreement with Stripe.
- Failed payments. If a renewal payment fails we will retry and email you. If it remains unpaid, your Store may be taken offline and, after a further grace period, your subscription cancelled.
- Taxes and price changes. Prices exclude any applicable taxes, which are your responsibility. We may change prices with at least 30 days' notice by email; changes apply from your next renewal.
5. Payments, Stripe and your customers
- Payments from your customers are processed by Stripe through a Stripe account you connect and control. By connecting it you also agree to the Stripe Connected Account Agreement. Funds from your sales are settled by Stripe directly to you; we do not hold your customers' money.
- You are the merchant of record for every sale in your Store. You are responsible for your products, pricing, descriptions, fulfilment, shipping, returns, refunds, customer service, sales taxes and compliance with consumer law where you and your customers are located.
- Refunds and chargebacks on your sales are between you, your customer and Stripe. Where a platform fee was charged on a sale you later refund, we refund our fee in proportion.
6. Your content and your customers' data
- You keep all rights to the content you upload — product photos, descriptions, logos, 3D models and brand assets (“Your Content”). You grant us a worldwide, non-exclusive licence to host, display, process and transmit Your Content solely to operate and promote the Service (for example, showing your storefront, generating share images, or listing your Store among active stores on our site — you may opt out of the latter by contacting us).
- You confirm you have the rights and licences needed to sell what you list, including for any third-party designs.
- Data about your customers and their orders is your data. We process it on your behalf to run your Store as described in our Privacy Policy, and you are responsible for your own privacy notice and legal basis for collecting it.
7. Acceptable use
You must not use the Service to: sell anything illegal where you or your customers are located, or that infringes others' intellectual property; sell weapons, weapon parts or items designed to defeat safety or security measures; sell counterfeit goods; send spam; upload malware; attempt to gain unauthorised access to the Service or other Stores; misrepresent who you are; or interfere with the Service's operation. We may remove content or suspend Stores that breach this section.
8. Domains and availability
- Every Store gets a subdomain of ours (for example your-shop.my3d.shop). Subdomains are allocated first come, first served, may not impersonate others, and revert to us when your subscription ends.
- You may connect a custom domain you own. You are responsible for registering, renewing and configuring it.
- We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, and we will try to give notice of planned downtime.
9. Our intellectual property
The Service, including its software, design, storefront templates and brand, belongs to us and our licensors. These Terms give you a limited, revocable, non-transferable right to use the Service for your Store while your subscription is active. You may not copy, resell, reverse-engineer or build a competing service from it.
10. Suspension and termination
- You may cancel at any time from your dashboard.
- We may suspend or terminate your access if you materially breach these Terms, if your subscription is unpaid, if required by law or by a payment provider, or if your use creates risk for us, other Stores or the public. Where practical we will warn you first.
- When your subscription ends your Store goes offline. You may export your products and orders from the dashboard before then; we may delete your Store's data after a reasonable retention period (see the Privacy Policy). Where you cancel under the money-back guarantee, operational data is deleted promptly.
11. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will meet your requirements or be error-free, and we are not responsible for third-party services (such as Stripe, carriers or domain registrars) that you use with it.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to the Service. Our total liability for all claims in any twelve-month period will not exceed the subscription fees you paid us in that period. Some jurisdictions do not allow certain limitations, so some of this section may not apply to you.
13. Indemnity
You will defend and indemnify us against claims, losses and expenses (including reasonable legal fees) arising from Your Content, your products, your Store's dealings with customers, or your breach of these Terms or applicable law.
14. Changes to these Terms
We may update these Terms from time to time. For material changes we will give at least 30 days' notice by email or in your dashboard. Continuing to use the Service after a change takes effect means you accept it; if you don't, cancel before then.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Courts located in Williamson County, Texas have exclusive jurisdiction, and you consent to their jurisdiction, except that either party may seek injunctive relief in any competent court. Nothing here limits consumer rights you have under mandatory local law.
16. General
These Terms, the Privacy Policy and any plan-specific terms shown at purchase are the entire agreement between us regarding the Service. If any provision is unenforceable the rest remains in effect. You may not assign these Terms without our consent; we may assign them to a successor of the business. Notices to you will be sent to your account email.
